We collect Personal Information that you voluntarily provide when you create an Account, use the Services, or communicate with us, including:

Identity information: name, date of birth, government-issued identification (where required for estate or legal coordination).

Contact information: email address, mailing address, telephone number.

Account credentials: username, password, and security questions.

Payment information: credit card, debit card, ACH, or other payment details processed through Stripe. We do not store full payment card numbers on our servers.

Profile information: photographs, biographical details, preferences, and communication preferences.

Communications: messages, emails, and other communications you send through or about the Services.

Given the nature of our Services, we may collect Sensitive Information, including:

Health information: terminal diagnoses, hospice or palliative care status, medical conditions relevant to end-of-life planning. We collect health information only to the extent necessary for Coordination Services and do not use it for purposes unrelated to service delivery.

End-of-life preferences: funeral or memorial wishes, burial or cremation preferences, organ donation wishes, religious or philosophical beliefs regarding death and dying.

Estate and financial details: asset inventories, property information, insurance policies, beneficiary designations, powers of attorney, will and trust details.

Family and relationship information: family structures, next of kin, emergency contacts, caregiver relationships.

Grief and emotional wellness information: information shared in connection with grief support services and death doula engagement.

We collect Sensitive Information only when necessary to provide the Services you have requested. Your consent is obtained through the following mechanisms:

At Account registration, you accept these Terms and this Privacy Policy through our clickwrap mechanism, which constitutes your general consent to data processing as described herein.

For specific categories of Sensitive Information (health status, estate details), you provide additional affirmative consent at the point of collection through intake forms that clearly identify the information requested and its purpose.

You may withdraw consent for Sensitive Information processing at any time by contacting hello@othersidelife.com. Withdrawal of consent may limit our ability to provide certain Services. We will inform you of the consequences of withdrawal before processing your request.

Consent records (including the date, scope, and method of consent) are logged and maintained by the Company.

When you access the Site, we automatically collect:

Device and browser information: IP address, browser type and version, operating system, device identifiers.

Usage information: pages visited, features used, clickstream data, session duration, referring URLs.

Location information: approximate geographic location based on IP address.

Cookies and tracking technologies: as described in our Cookie Policy.

We may receive information about you from Vendors you engage through the Platform, payment processors (Stripe), identity verification services, public records databases used for estate coordination, and analytics providers.

We may create de-identified or aggregated data from Personal Information by removing identifiers that would allow it to be linked back to you. De-identified and aggregated data is not Personal Information and may be used for analytics, research, product improvement, and business operations without restriction.

We use Personal Information and Sensitive Information for the following purposes:

Service delivery (basis: contractual necessity): To provide, maintain, and improve the Services, including matching you with Vendors, facilitating Coordination Services, managing payments, and communicating with you about your service engagement.

Vendor coordination (basis: contractual necessity and consent): To share necessary information with Vendors you have been matched with or have engaged, solely to facilitate the delivery of professional services.

Account management (basis: contractual necessity): To create and manage your Account, authenticate your identity, and process transactions.

Communications (basis: legitimate interest and consent): To send service-related communications (confirmations, updates, alerts, support). Marketing communications are sent only with your express consent and you may opt out at any time.

Security and fraud prevention (basis: legitimate interest): To detect, investigate, and prevent fraudulent, unauthorized, or illegal activity.

Legal compliance (basis: legal obligation): To comply with applicable laws, regulations, legal processes, and governmental requests.

Platform improvement (basis: legitimate interest): To analyze usage patterns, conduct research, and improve the Platform and User experience. Where we use Sensitive Information for improvement purposes, we use de-identified or aggregated data only.

We collect and process only the minimum Personal Information and Sensitive Information necessary for the stated purposes. Access to Sensitive Information within the Company is restricted to personnel who require it for service delivery, and is subject to role-based access controls.

We share your Personal Information and Sensitive Information with Vendors you have been matched with or have engaged through the Platform, solely to the extent necessary to facilitate the delivery of their professional services. Each Vendor receives and processes your information as an independent data controller for the professional services they provide. The Company does not direct or control Vendors’ independent use of your information for their own professional purposes. Vendors are contractually required to maintain confidentiality and security through the Vendor Service Agreement, and to use your information solely for the purposes of delivering their professional services.

We share information with third-party service providers who perform services on our behalf as data processors acting under our instructions, including:

Payment processing: Stripe (PCI-DSS compliant).

Customer relationship management: Zoho One (CRM, Campaigns, Bookings, Sign, Analytics, Flow, Books).

Communication platforms: OpenPhone, email service providers.

Analytics: website analytics and performance monitoring tools.

Cloud infrastructure and hosting providers.

Service providers are contractually obligated to use your information only for the purposes for which it was shared, to follow our instructions regarding data processing, and to maintain appropriate security measures.

We may disclose your information if required by law, regulation, legal process, or governmental request; if we believe disclosure is necessary to protect the rights, property, or safety of the Company, our Users, or the public; or in connection with the investigation of fraud, security incidents, or violations of our Terms of Use.

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of the Company’s assets, your information may be transferred as part of that transaction. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

We do not sell your Personal Information as defined under the CCPA/CPRA. We do not share your Personal Information for cross-context behavioral advertising. Our current marketing activities are limited to first-party communications (email marketing through Zoho Campaigns to users who have opted in). We do not use third-party advertising pixels or retargeting tools that would constitute a “sale” or “sharing” under the CCPA/CPRA. If our marketing practices change, we will update this Policy and provide notice before any such change takes effect.

If you are a California resident, you have the following rights:

Right to Know: Request information about categories and specific pieces of Personal Information collected, sources, purposes, and third-party recipients.

Right to Delete: Request deletion of your Personal Information, subject to certain exceptions.

Right to Correct: Request correction of inaccurate Personal Information.

Right to Opt-Out of Sale/Sharing: As stated, we do not currently sell or share your Personal Information.

Right to Limit Use of Sensitive Information: Direct us to limit our use of Sensitive Information to what is necessary to provide the Services.

Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

You may designate an authorized agent to submit requests on your behalf. We may require verification of the agent’s authority and your identity.
